i return to the white house more determined and more inspired than ever about the work there is to do and the future that lies ahead. president barack obama is elected for the second term vowing to unit a bitterly divided nation. upsetting congress coming up. we'll take a look at the results from the congressional races. we'll tell you who will keep their seat and who will lose it. california voters decide to raise their own taxes.

how governor jerry brown convinced them to do it. we're live in san jose we'll tell you which measures passed in santa clara county and which didn't. you may be surprised to find that out. good morning, to you. welcome to a brand new day it's wednesday november 7th i'm dave clark. >> good morning, i'm pam cook. thank you for waking up with us this morning. let's check in with steve paulson. the weather is already changing i guess. but i did vote for warm weather, steve. >> then election came in for you on monday and tuesday. but for us rooking for colder weather the results will show up later today and more likely tomorrow. we have a very strong cold front coming in. today is that between day. 60s and 70s. a lot of the fog and low clouds are back. temperatures will begin their cool down. traffic on 24 westbound between walnut creek and oakland looks good. the fog is not low here.

steve has mentioned the fog. definitely foggier and chillier. the commute looks good on 80 now. but this last night there the freeway waclosed for more than five hours. this taxi cab happened in san francisco. it happened about two hours ago on 8th. the cab driver lost control and hit two parked cars and a parking meter before crashing into the side of the market there. firefighters had to use the jaws of life to get the driver out. the driver was injured. we don't know his condition. no one else was hurt. it's not clear what caused this crash. you see some of the debris a parking meter ended up on top of that little scaffolding there outside the market. it's a pretty dramatic crash. again one person was seriously injured. now let's go back to the desk. all right, thank you, sal. topping our news a day after election day it is four more years for president obama final

results still being counted but here's the electoral map. the state of florida yellow because it remains too close to call but the president has at least 303 electoral votes. 270 are needed to win the white house. thousands of supporters cheered as the president, first lady, and daughters emerged at their victory party in the early morning hours of chicago in his victory speech president obama spoke about working with both sides of the aisle. >> we are greater than the sum of our individual ambitions and we remain more than a collection of red states and blue states. we are every forever will -- we are every forever will be the united states of america. >> the president and his family spent the night in chicago will return to the white house this afternoon. mitt romney lost his bid to become president but during his concession speech he urged the

nations leaders reach across the aisle and work together. he made that concession speech just after midnight after he called president obama and congratulated him on his victory. romney told his supporters he and ryan gave everything they had to the campaign. >> i so wish i would have been able to fulfill your hopes to lead the country in a different direction, but the nation chose another leader so ann and i join with you to earnestly pray for him and this great nation. >> romney also thanked his wife, sons, his staffers for all their support. and then his running mate paul ryan. ryan returns to congress after voters in wisconsin reelected him to represent wisconsin's first district. more than a dozen congressional districts up for grabs in this election. as the numbers came in we saw decisive victories. >> we have ktvu claudine wong in the studio with us right now. you have all those numbers. >> that is right. i want to take you right to

this congressional map. of course the one district we talk about this morning when you talk about upset is right here. that is district 15. the lines were redrawn. we had a top two tier primary system. but no longer that is changing. take a look at these numbers after holding on to the seat for 40 years this 80-year-old is out and 31-year-old democrat erik swalwell is in. 53% to 47% with 100 precincts reporting. a couple of other close races to note. if we go over to district three we want to show you the results from that race. he is holding ton his seat by a number of 54% to 46%. close. but he beat out kim vann saying that they needed a grocery store politics scene not a career politician.

now quickly to district nine. jerry mcnerney he is the winner. awfully close. if we go back to the big map 14 congressional districts up for grabs. 13 incumbents including pelosi, lee, miller all headed back to capitol hill. most do it in indecisive fashion. >> the elections did not change the balance of power on capitol hill. democrats still controlled the u.s. senate. coming up at 6:15 what all of that means for the lawmakers moving ahead and what is ahead for the gridlock in washington. >> governor jerry brown is celebrating a historic victory this morning for the first time since 2004 california approved a tax hike on a statewide proposition. voters have passed proposition 30. his education tax initiative 54% to 46% with 95% of the precincts reporting. ktvu tara moriarty is in san

francisco this morning where voters were overwhelmingly backing that measure. >> that is right here in san francisco most voters voted yes in favor of prop 30. and the general feeling here in the city is that public schools need help. case in point mission heights school. this is the oldest high school in san francisco and test scores well they have been struggling with that over the years. prop 30 passage may be the shot in the arm this school needed. other areas of california that saw support for 30 alameda and santa cruz counties. los angeles also backed it but moe dark and more rural central areas of the state saw the least amount of support. prop 30 will raise the states sales tax by a quarter of a credit for four years and increase income taxes for people who make $250,000 a year by up to three percentage points. it is projected to raise $6 billion a year for schools. >> a core reason that brought people together in support of

proposition 30 was the belief in our schools and our university and in the capacity of the state government to make some wise investments that will benefit all of us. >> reporter: now brown made prop 30 the focus of his administration spending the year trying to convince voters to pass it and educators said it saves them from having to make drastic cuts. so in seven years they say they can be right back where they started. brown's campaign raised more than $40 million. mostly from teachers union and labor groups. coming up we'll talk to parents and teachers and find out how they feel about prop 30 this morning. live in san francisco i'm tara moriarty ktvu channel 2 news. california's rejected the rival tax measure proposition 38. take a look at your screen. 72% voting no. 28% yes. that is 95% of precincts reported. it was funded by a millionaire

attorney and would have raised the taxes of middle and upper class income households. 6:08. santa clara county voters decided on several ballot measures on election day. ktvu janine de la vega live in san jose. you can tell us some of the results. good morning, janine. >> reporter: good morning. all these measures centered around money one of the measures that didn't pass that seemed to be a shock to at least the people we spoke to this morning was measure that centered around gambling and that is measure e. now 42% of the people voted yes. and 58% were against it. now this measure would have increased the amount of gaming tables at san jose's two card rooms. proponents said it would have generated $20 million in tax revenue for the city. political analysts thought this might have been a slam dunk because it seemed like an easy way to get money by taxing casinos. opponents argued it leads to an increase in crime and would have cost taxpayers more in the

long run. >> i don't believe gambling results in crime. i on aquations i'll go to -- i on occasions would go to a card room and i'm not a criminal. i believe they should have passed that. >> reporter: now a measure that did pass was raising the minimum wage in the county. that is measure d. 59% of people approved it while 41% rejected the measure. minimum wage will be increased from $8 an hour to $10 an hour. this measure was developed by a group of san jose state students. it was also championed by labor unions. another measure approved was measure a. that was involving the sales tax. 56% voted yes while 44% voted no. measure a increases the sales tax one eighth of a cent for the next ten years in the county and it's estimated to raise $50 million annually for county programs such as valley medical center, public health, and the local law enforcement. we will have more reaction on

all these measures and what is taking place later on the morning news. reporting live janine de la vega ktvu channel 2 news. right now it's 6:10. a lot of people getting ready to head out the door. let's check in with sal. hopefully no problems. >> it looks pretty good pam and dave if you are driving around the bay area. although the toll plaza area is getting a little bit more crowded. as you would. the metering lights have been going on a little bit early. that might become the new normal. it used to be 6:15 when we've seen this crowd. right now it's more 6:08-6:07. that is what you are seeing. here in oakland it has been a nice looking drive with no major problems and the commute looks good on 580 is well. san jose southbound 17 looks okay at hamilton avenue there is a crash on the shoulder. northbound 280 does look good into cupertino. let's go to steve. thank you. we had record highs monday and

tuesday. not today. we'll go from record highs to really cold temps but today is that transition day. the fog has returned. breezy and cooler. turning colder tonight. late thursday into friday i think we will get some rain out of this. again this is more of a dry system. but it definitely packs a lot of cold air. the record highs from tuesday 91 yesterday in gilroy. san jose was 80. oakland 80. oakland airport was 82. redwood city 80. today that all ends. we get that westerly direction instead of that eastern, northeast that is what you really need to get the record heat this time of year. that is gone now. with that in mind from being 10- 15 degrees above average on temperatures from this time of year will slide into near average and go below tomorrow and definitely below on friday. again some said my weather app is going from 57-58.

upper 40s to low 50s. everyone is a lot closer. we had 47 hah- we had 45-61 on the lows. there is the system right there it will move in and give us high clouds. big system in the northeast continue to churn up. there have been gusts 50 plus miles an hour. this is not a howling system. the mere fact it comes in a week after sandy is causing problems. fog, sun, cooler for us. a westerly wind. fog on the coast. also some of that is over the bridges and moving in locally. 60s and 70s on the temps. they'll continue to slide down today. out of those 80s and goodbye to the 80s on the coast. colder showers developing on thursday and very cold kind of a rainy off and on pattern on friday. the weekend looks better. very cold in the morning. 6:13. new details about a man that was killed in an officer involved shooting in fremont. what the man's family is saying about his mental state at the time of that shooting. the decision on a controversial measure that would ban sitting around on the

streets of berkeley. we are more election results for you right now. look at your screen. prop 33 which would make changes in auto insurance. seems to be lagging right now. the yes vote 45% the no vote 55%.

area is heading back to washington. california has reelected senator dianne feinstein to a fourth term. she has defeated elizabeth emken. the votes coming in 62% for feinstein 38% for emken. feinstein hugged her family. she choked up when a granddaughter introduced her on to the stage. time is you have 17. the 17 -- the time is 6:17. the new congress will look like the old one. alison. >> reporter: republicans keep the house, democrats hold on to the senate. let's take a look here at the latest senate tally. 51 democrats keep the majority. 45 republicans, two independence. two races still undecided. democrats captured republican seats in massachusetts and

indiana as elizabeth warren defeated scott brown and democratic representative joe donnelly beat tea party favorite richard mourdock. even though democrats secured a few more seats in the house republicans stay in charge. president obama is vowing to make progress inspite of a divided congress. >> you elected us to focus on your jobs not ours. and in the coming weeks and months, i am looking forward to reaching out and working with leaders of both parties to meet the challenges we can only solve together. >> reporter: but house speaker john boehner is already laying the battle lines. he sent us a statement saying the election was not a mandate for tax increases. speecher boehner and senate majority leader harry reid are both holding news conferences today. reporting live from washington, d.c. alison burns. back here at home voters in

berkeley rejected controversial sit, sly law. it would have banned sitting on sidewalk in commercial areas from 7:00 in the morning to 10:00 at night. it was needed to drive away aggressive panhandlers. but some say it criminalized homeless. voters also defeated a temporary parcel tax for the contra costa county fire district with all the precincts reporting that measure fell well short of the two-thirds it needed to pass. contra costa fire district official said ten fire stations could be closed and a third of the firefighters could be laid off if they measure did not pass. in other news this morning an overnight shooting in san jose seriously injured one man. that happened at 9:30 last night at south winchester boulevard. two men were shot but only one victim was found. he was rushed to the hospital with life threatening injuries. in august another man was shot

and injured. a san jose man who was killed by fremont police was grieving the loss of his brother. the contra costa times reports dwayne eaton had just learned his younger brother shot himself when he got into a domestic violent incident with his wife sunday night. police responded to the home and say they were forced to open fire when he refused to drop his weapon. his father says his son was eight times but police have not released information on how many times he was hit. time is 6:20. our commute is picking up now. and sal, we've got a new crash in contra costa county. >> that is right eastbound 24 dave and pam on wilder at the other side of the tunnel. eastbound 24 you know how bad it is trying to get up there at this time. there is only one tunnel. if you drive in the countercommute direction on eastbound 24 pretty soon we will see a backup here. eastbound 24 at wilder thick fog up there near the

caldecott. watch out for that. there is traffic going to be effected westbound as well. and the fog is moving through. i'm just looking at my traffic pictures. steve is the real expert on this. let's move along and take a look at westbound bay bridge. doesn't look too foggy here. and if you are driving on 880 north and southbound that traffic here does look pretty good. let's bring in steve. mainly low clouds, sal. a little bit higher for fog. but there are some pockets of it out there. some of the hawaiier elevations. higher elevations. low clouds, fog. fog and sun cooler and breezy today. 60s and 70s. reason why we are going to cool town a weak little system coming in. it was out there. just couldn't go anywhere. because of an east wind. today we get more of that westerly breast will bring temperatures down. some of the fog could have dense visibility. overall it's kind of up there. turning colder tonight. clouds increase.

the wind will pick up overnight as that system senator mccain move plus mainly 50s. some upper 40s in there. but temperatures through the coast are a lot cooler than they were yesterday at this time. front doesn't have a lot of rain with it but it does have a lot of cold air. low clouds, fog, cooler. it looks like the low cloud deck will be hugging the coast there. much, much cooler. 60s and 70s on the temps. if anything might even say goodbye to the 70s. by tomorrow 60s. a colder rainy pattern drops in on friday. 50s for high. cold saturday morning and clearing out and breezy. better on sunday just not very warm. thank you, steve. 6:22 is the time right now. there is a new development in the saga of former san francisco giant cabrera. the findings of an investigation into his agent for accused of helping cover up his use of performance enhancing drugs. a shakeup for the oakland city council. who won the contest between two high profile council members. and on to more election

results. proposition 31 which would require government performance reviews and two-year budget cycles finally defeated overnight. 61% no. 39% yes.

a big shakeup in the oakland city council. long-time council member was defeated in his bid to unseed incumbent rebecca caplan for the at large seat. kaplan easily defeated fuente 36% to 30%. and the spread was bigger after ranked choice voting. the 63-year-old fuente gave up his seat representing district five in order to challenge kaplan. the major league baseball union has cleared cabrera's agent. they will be disciplined for their failure to supervise juan yuan non. cabrera was suspended for 50 games in august and not added

to the giants post season roster. san francisco holiday traditions get under way today. both outdoor ice rinks will open at 10:00 this morning. the rink at union square will donate some of its admission to the boys and girls club on san francisco. outdoor rinks in walnut creek and san jose open next week. some tough stuff to see. sal, you're seeing problems on highway 24 and elsewhere. >> we are seeing problems on highway 24 at wilder. there is a crash that could be blocking all the lanes eastbound 24 the orinda fire department son the scene. big rig is overturned and now traffic is coming to a dead standstill. those who drive on eastbound 24 trying to get out there you know what it's like. it's only one tunnel in this direction and now it looks like all the lanes may be blocked. i would advise you to get on highway 13 head south to 580

and use 580 to get over to that side. you may be suck in horrible traffic. let's move along and take a look at the bay bridge toll plaza westbound that traffic is backed up to a 20 minute delay. let's go to steve. we have a lot of low clouds. very thick fog toward san jose. definite sign of a pattern change here. temperatures will be dropping fast thursday into friday. system come into the north doesn't have a lot of rain but cold air. time now 6:28. a family in the east bay barely escaping flames just hours ago. we'll tell you what we're finding out about this fire and how it effects the family now. and we're live in downtown oakland where people are waking up to the news the president will be serving another four years in office. their reactions coming up. i wish i had u-verse when i was your age. in my day, we didn't have these fancy wireless receivers. blah, blah, blah. if i had a sleepover, i couldn't just move the tv into the playroom.

where it has been here since 1907. this is the san francisco chronicle you can see it says it's obama. we look at the oakland tribune obama rolls. then we look at the new york times as well says obama's night. and talks about how he tops romney for a second term. when we got here there were a lot more papers on these new stands but these have been selling like hot cakes. people here in oakland are very excited the president will be serving another term. >> absolutely exuberant. it was great just absolutely fantastic. i knew he would win. even though my heart was pounding i knew he would win. >> reporter: what makes you so excited about the president's next term? >> four more years. >> reporter: simple as that right? >> simple as that. >> reporter: and it was simple as that for a lot of the people

we talked to here. a lot of people very excited the president is serving a second term. a lot of the newspapers are selling like hot cakes. a lot of people say the president they were very confident in the president's role that he did in the past four years and they are excited that he will be again serving in the next four years as well. we are live here in oakland i'm brian flores ktvu channel 2 news. time now 6:35. one of the most creasely watch -- closely watched states in california was proposition 30. that is the governors education tax initiative. voters pass that measure. 54-46%. this is the first time since 2004 the california voters passed a statewide tax hike. ktvu tara moriarty live in san francisco to tell us what this all means for california's public schools. good morning, tara. >> reporter: good morning. governor jerry brown is

expected to hold a press conference to discuss the election results. obviously prop 30's passage a huge victory for him and for schools like this one. this is mission high school. it's the oldest high school on its site that struggled with test scores over the years. brown spoke to supporters at the -- no one else in the country would people vote for an education tax. >> proposition 30 is a unifying force. and we had to overcome a lot of obstacles. we overcame yes on 30, yes on our kids, yes on california. we're all in it together. thank you very much. [ cheering and applause ] >> reporter: now prop 30 will raise the state's sales tax by a quarter of a cent for four years and increase state income taxes for people who make $150,000 a year. it's projected to raise $6

billion a year for schools. now san francisco voters overwhelmingly supported prop 30 as did people in alameda and santa cruz county. where did voters shoot it down? find it coming up in our next half hour. i'm tara moriarty ktvu channel 2 news. >> competing measure proposition 38 was soundly defeated. the yes vote came in at 28%. the no vote 72%. this was bank roled by a millionaire attorney. it would have raised the taxes of middle and upper class families. we are tracking overnight news out of newark where fight fighters are look into the cause of -- firefighters are looking into the cause of a house fire. two people that lived in the home say they were awakened by the flames. they managed to grab their four children and get out of the house safely. >> my husband and our three- year-old were asleep in bed.

and we just saw -- i just woke up and saw red. >> the red cross is helping that family find a place to stay. they believe the family dog died in the fire. time now 6:37. let's bring sal back now sigh what is happen -- see what is happening on the roads. >> we've had a lot of slow traffic. we have a major problem on eastbound 24. eastbound 24 at the caldecott tunnel. there is a crash at wilder road. this crash is blocking almost all of the lanes and it's a huge problem because at this time of the morning, we only have one tunnel that is open in the eastbound direction. you are trying to get out to walnut creek i would not advise using 24. if you're getting on the freeway in orinda that is different story that would be fine. out to the bay bridge toll plaza we go and the traffic here is looking good. with no major problems although it is backed up with the

standard delay of 20 minutes now. if you're driving in the south bay northbound 280 traffic, that is a little foggy there. steve called it low clouds. 6:38 let's go to steve. low clouds and fog. no doubt about it. my buddy john said paulson got to sound the fog horn because it's thick. other areas the fog has lifted a little bit and it's back. the fog returns. it will be breezy and cooler today. tomorrow turning colder. we had our warm weather monday and tuesday. it's a memory now. because not so much of a rainy system but this will be a colder system. especially by friday highs will be in the 50s. clouds and some rain possible with us. some snow up in the sierra nevada. it doesn't look like much of an event for precipitation. yesterday 80s and 90s for many. san jose was 80. oakland 80. redwood city 80. sfo add 78 degrees -- at 78 degrees. just a few more record highs. temperatures were 10-15 above normal.

now we are getting a earl breeze. temperatures drop today. they will continue to drop into friday and level out. not much of a system up here but that is definitely picked up the fog. that is a big change. 40s to 50s. the temperatures spread was about 15-16 degrees yesterday. i mean san francisco is sitting in the low 60s. now they're at 54-degrees with that fog and westerly breeze. again not a lot of rain with this. the cold air is upstream. this is your cloud, rain forecast. see how the system will increase. shower activity going through. that will take us into friday. a better opportunity i think on friday. again it's the cold more than the rain with this system. but it will linger into saturday morning. low clouds, fog, sun, cooler. westerly wind in place instead of an east or northeast. 60s and 70s now. temperatures on their way down and they will continue to slide down with that westerly breeze. these 70s tonight think it will last too long. cold we are showers into thursday. cold kind of off and on rainy day. weekend will be better just not very warm. president obama will head back to the white house later

today and he has four more years in the white house. is rene marsh. >> reporter: dave, this was ground zero for the obama campaign on election night. we saw that the supporters they were all pack into the convention center here mccormick place here in chicago and they went wild when they heard the president was reelected. and of course we heard from the president this evening. he talked a bit about what he would do moving forward and that included some bipartisan ship. he mentioned he planned on getting on the phone with mitt romney. talking to him a bit about how to move forward from here. of course the big issue that the president now faces is the fiscal cliff he will have to work with in congress to figure out what will be done before that deadline at the end of the year.

the table. so again a big change in our pattern. leading edge of it coming into the northern part of the state. this is kind of picked up the fog which is why it's there. over time it will lift it. 40s and 50s on temps. much, much cooler air mass in place already compared to last couple of days. not a lot coming in right there. a lot of high mid level clouds but that will set the stage for cloud and rain forecast. has a lot of low clouds in it. also that breeze out of the west instead of the north, northeast. draw your attention to the top of the screen there. that is coming in on thursday and then right there that has to come in on late thursday into friday. that will give us some rain and mountain snow. westerly wind fog. there is a lot of fog out there. it will be cooler. 60s and 70s on the temps. they will drop pretty fast here. 60s. 59 pacifica. one of the warmest locations will be gilroy 77. but that is down from 91 yesterday. we do have a colder pattern. kind of a shower yi pattern --

incumbent supervisor christina olague's vote to keep sheriff ross mirkarimi as sheriff may have cost her her job. she is trailing challenger london breed the executive director of the african american art and culture complex. richmond's soda tax went down in defeat. voters overwhelmingly rejected measure n which would have imposed a penny per ounce tax on sugary drinks. if passed richmond would have been the first in the nation. the american beverage association contributed $2 million to help defeat that. also defeated proposition 37 which would have required labeling for foods that would have been genetically engineered. it lost 53-47%. sal is backing talking -- back talking about big problems. >> that is right eastbound 24. i want to put it on the maps. very slow traffic in both directions. in fact, i think i have to pull
